The Website is owned and operated by Parenting for Confident Kids Summit (“PFCKS,” “we,” “us,” or “our”).

The Website is offered subject to your acceptance, without modification, of all the terms and conditions contained herein and all other operating rules, policies (including, without limitation, PFCKS’s Privacy Policy), and procedures that may be published from time to time on this site by PFCKS (collectively, the “Agreement”).

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the Website, you agree to become bound by the terms and conditions of this Agreement. If you do not agree, you may not access the Website or use any services. If these terms and conditions are considered an offer, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 13 years old.

1. Payment and Renewal

General Terms

By selecting a product, service, or upgrade, you agree to pay PFCKS the one-time and/or recurring subscription fees indicated (monthly, quarterly, or annual, as specified). Subscription payments will be charged on a pre-pay basis on the day you sign up and will cover the use of that service for the relevant subscription period.

All sales are final. Payments made more than 12 months prior (regardless of terms) are non-refundable.

Discounts: Promotions or discounts offered after your purchase do not entitle you to refunds.

Account Access: If you cannot locate your login details, visit the Website login page and use the “forgot password” link. If still unable to access, contact [email protected]. Failure to receive an email confirmation does not constitute grounds for refund.

Automatic Renewal

For recurring subscriptions only: Unless you notify PFCKS before the end of your subscription period that you wish to cancel, your subscription will automatically renew. You authorize PFCKS to collect the applicable fee (plus taxes) using your payment method on file. Charges made before a cancellation request are not refundable.

Money-Back Guarantee

If a money-back guarantee is offered, eligibility requires that you:
a) Request a refund within two (2) weeks of purchase.
b) Fully participate in the program as outlined (e.g., attend required sessions, complete assignments).
c) Complete all orientation requirements.

Failure to meet these conditions voids eligibility.

2. Responsibility of Website Visitors

PFCKS has not reviewed all materials posted on the Website and is not responsible for their content, use, or effects. Visitors are responsible for protecting themselves and their systems from harmful content. The Website may contain content that is offensive, inaccurate, or objectionable, as well as links to third-party content. PFCKS disclaims responsibility for harm resulting from Website use.

3. GDPR/UK GDPR Compliance

You agree that PFCKS will process personal data you provide to deliver products, services, and communications. By accepting this Agreement, you confirm you have read and accepted our Privacy Policy.

Legal bases for processing include consent, contract, legitimate interests, and compliance with legal obligations. International transfers will follow appropriate safeguards (e.g., Standard Contractual Clauses).

4. Content Posted on Other Websites

PFCKS has not reviewed all content available through sites linked to or from the Website and is not responsible for external content. Linking does not imply endorsement. Use third-party sites at your own risk.

5. Copyright Infringement and DMCA Policy

PFCKS respects intellectual property rights. If you believe material on the Website violates your copyright, notify PFCKS in accordance with the Digital Millennium Copyright Act (DMCA). PFCKS may remove infringing material and, if appropriate, terminate repeat infringers’ access. No refunds will be provided for terminated accounts.

6. Intellectual Property

This Agreement does not transfer any intellectual property rights. All rights, titles, and interests in and to PFCKS materials remain solely with PFCKS. Your use does not grant you any license to reproduce or otherwise use PFCKS’s trademarks or content.

7. Advertisements

PFCKS reserves the right to display advertisements unless you have purchased an ad-free account.

8. Attribution

PFCKS reserves the right to display attribution links (e.g., “Site powered by Parenting for Confident Kids Summit”) in the footer or toolbar.

9. Partner Products

By activating a partner product (e.g., theme, tool, or integration), you agree to that partner’s terms of service. You can opt out by deactivating the partner product.

10. Changes

PFCKS may modify this Agreement at any time. Your continued use of the Website after changes are posted constitutes acceptance. New features will also be subject to this Agreement.

11. Termination

PFCKS may terminate your access at any time, with or without cause or notice. Paid accounts may only be terminated for material breach if not cured within 30 days of notice. Certain provisions (ownership, warranties, indemnity, limitations of liability) survive termination.

12. Disclaimer of Warranties

The Website is provided “as is.” PFCKS disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. PFCKS does not guarantee uninterrupted or error-free access.

13. Use of Likeness

By participating in PFCKS programs, you grant PFCKS the right to record, photograph, or otherwise capture your likeness, voice, and statements (excluding private coaching unless you consent) for lawful use, including promotional and educational purposes.

14. No Guarantee of Results

PFCKS provides resources intended to support learning and growth but does not guarantee outcomes. Success depends on many factors beyond PFCKS’s control. Testimonials and case studies are illustrative only and do not guarantee results.

15. Confidentiality

PFCKS’s methods, processes, and strategies are proprietary and confidential. You agree not to share or distribute program materials outside permitted use. Breach may result in legal action.

16. Limitation of Liability

PFCKS and its affiliates will not be liable for special, incidental, or consequential damages, or amounts exceeding fees paid in the twelve (12) months prior to the cause of action. Liability exclusions apply to the fullest extent permitted by law.

17. Representation and Warranty

You represent and warrant that your use of the Website complies with this Agreement, PFCKS’s Privacy Policy, and all applicable laws, and does not infringe third-party rights.

18. Indemnification

You agree to indemnify and hold harmless PFCKS, its contractors, licensors, directors, officers, employees, and agents from claims and expenses (including attorneys’ fees) arising from your use of the Website or violation of this Agreement.

19. Arbitration Agreement

Any disputes shall be submitted to binding arbitration, conducted individually and not on a class basis, in accordance with the rules of JAMS (www.jamsadr.com). The arbitrator’s decision shall be final. The prevailing party may recover legal costs to the fullest extent allowed by law. Unless otherwise required, arbitration will be conducted virtually or in a mutually agreed jurisdiction.
